Any offensive postings will be immediately deleted. International Adoption Guide will endeavour to ensure that the forum is scam free but cannot be held responsible for any scam that makes its way through its security systems. MEMBERSHIP
It is understood that when someone becomes a member of International Adoption Guide the relationship between member and International Adoption Guide becomes contractual. In entering into the contract neither the member nor International Adoption Guide intends that any of the terms of the contract will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not party to it.LEGALITY
International Adoption Guide endeavors to be compliant with Statutory Instruments and any breach herein is manifestly unintentional. International Adoption Guide operates as an individual and is not an adoption support service and does not provide counseling, advice or information. All content has been acquired from personal experience and/or is found in the public domain. International Adoption Guide operates under Article 19 of the Universal Declaration of Human Rights Act which allows the freedom of opinion and expression and the freedom to communicate and to pass and receive information and ideas without being censored or persecuted. It is the intention of International Adoption Guide to uphold Article 16 of the Universal Declaration of Human Rights Act which states that Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. And it is to this desire to found a family that directs the content. It is within the understanding of International Adoption Guide that the content contained herein is not a threat to national security, or public safety. It in no way intends to infringe on anyone’s health or morals and does not mean to incite crime or disorder or endanger or harm others. No communications that have been received in confidence have been disclosed without the express permission of those responsible. Regarding Article 21 which recognizes Inter-national adoption the sole purpose of International Adoption Guide is to facilitate the empowerment of those who can beget this.
RIGHT TO REFUSE SERVICE?
At its sole discretion, International Adoption Guide has the right to refuse any and all service or services to any applicant, customer, client whether it be an individual or legal entity??
LIMITATION OF LIABILITY
You agree that International Adoption Guide will not be responsible for any losses that may incur where Services are accessed by third-parties through illegal or otherwise unauthorized means, including but not limited to situations where data is accessed through the exploitation of security gaps, weaknesses or flaws (whether known or unknown to International Adoption Guide at the time) which may exist in the Services or in International Adoption Guide equipment used to provide the Services. Under no circumstances will International Adoption Guide be liable for any consequential, indirect, incidental, special or punitive damages, or loss of profits, revenue, data or use by Members/Customers, any of its members or customers, or of any other third-party, whether in an action in contract or tort or strict liability or other legal theory. International Adoption Guide will not be liable to Member/Customer, any of its members or customers, or any other third-party, for any loss or damages that result or are alleged to have resulted from the use of or inability to use the Services, or that results from mistakes, omissions, interruptions, deletion of files, loss of data, errors, viruses, defects, delays in operations, or transmission or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to International Adoption Guide’s records, programs, equipment or services. Notwithstanding anything to the contrary in this Agreement, International Adoption Guide’s maximum liability under this Agreement for all damages, losses, costs and causes of actions from any and all claims (whether in contract, tort, including negligence, quasi-contract, statutory or otherwise) will not exceed the actual sterling amount paid by Member/Customer for the Services which gave rise to such damages, losses and causes of actions during the 12-month period prior to the date the damage or loss occurred or the cause of action arose.??This limitation of liability reflects an informed, voluntary allocation between the parties of the risks (known and unknown) that may exist in connection with this Agreement. The terms of this Section will survive any termination of this Agreement.
PAYMENT OBLIGATIONS, RENEWALS AND CANCELLATIONS ?
Payment Obligations: Payment is required in advance, before membership access is established. You grant International Adoption Guide the right to debit the credit card or bank account via our online billing services PayPal, depending on the form or payment and currency you choose to pay in. You will be billed until the service is cancelled by you in writing or is cancelled by International Adoption Guide, according to terms of this Agreement. You agree to a minimum membership period of 3 months. You warrant and represent that the information you supply in the Order Form (or other information that International Adoption Guide may require) is accurate and truthful. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or FAX. If no payment is received by the renewal date, your membership will be suspended within 10 days after payment due date. Any suspended membership will be terminated within 15 days after payment due date if no payment is received within this time.??Renewals: Your account will be automatically renewed under the same time and fee structure unless you give written notice to International Adoption Guide two (2) days before the renewal date that you do not wish to renew such account.
?Cancellation: You may cancel at any time after the minimum 3 month period has passed. To cancel an account, send a short e-mail message with your name, username, and member password to: admin@internationaladoptionguide.co.uk. If you cancel before the first 30 days, please refer to the details under "Limited 30-day Money Back Guarantee”. If you cancel after 90 days from the opening of your account, the admin fee will be forfeited. All cancellations must be received in email 15 days before payment deadlines indicated by e-mail . Cancellations will be processed by our staff on a weekly basis. ?
LIMITED 30-DAY MONEY BACK GUARANTEE?
If you are not completely satisfied with our services within the first 30 days from the opening of the account, you will be given a full refund on your subscription fee excluding the one-off initial administration fee. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase. If your account has been cancelled by us due to a breach of the terms and conditions on your part, you will not be eligible for a refund.
INDEMNIFICATION?
Member agrees to indemnify, defend and hold harmless International Adoption Guide, its officers, directors, employees, shareholders and agents from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative), and expenses (including, but not limited to, reasonable legal fees) threatened, asserted, or filed by a third-party arising out of or relating to (i) Member's use of the Services, (ii) any breach by Member of this Agreement, or (iii) any acts or omissions of Member. The terms of this Section will survive any termination of this Agreement.
FORCE MAJEURE
International Adoption Guide will not be liable for failure or delay in performing its obligations if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labour disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third-party services, failure of third-party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provision of the Services.
ILLNESS/LEAVE
It is within the Rights of International Adoption Guide to have periods of absence due to illness or vacation. These periods will not be longer than a period of 14 days. If absence extends this period than members will be notified in writing. If the service of International Adoption Guide is delayed by more than 90 days a membership suspension order will come into force, where subscriptions and services will be suspended until there is a return to normal service. If in the unlikely event International Adoption Guide ceases to trade then any subscription fees already paid following the cessation of trade date will be returned in full with a deduction of an admin fee of £30.
GOVERNING LAW; JURISDICTION; ARBITRATION?
In the event of recourse to legal action, both parties agree to submit to personal jurisdiction in the state of International Adoption Guide’s incorporation (UK), and the agreement shall be governed by the law of the United Kingdom. An award rendered in connection with arbitration pursuant to this Section shall be final and binding upon the parties. The parties agree that the award of the arbitrate tribunal will be the sole and exclusive remedy between them regarding any and all claims and counterclaims between them with respect to the subject matter of the arbitrated dispute. The terms of this Section will survive any termination of this Agreement.
